Can You Freelance Under a TN Visa Through Your Own Company?

A question I came across recently was whether someone can work a freelance job under their own company. Specifically, the question was:

“Can we register a company and freelance under that company with a TN visa?”

Under a TN visa, self-employment is generally not allowed. But how is self-employment determined? According to regulations:

  1. If you are providing services to an entity, and
  2. You are the sole or controlling shareholder (or owner) of that company,

You are considered self-employed. However, you may still be eligible for a TN visa if you are a minority shareholder or owner and employed by the company itself.

That said, it’s strongly recommended to consult with an immigration lawyer to ensure your employment arrangement isn’t classified as self-employment.
